These Website Terms of Use (the "Terms") apply to usepurewater.com and to the request forms, checkout links, and account tools we provide on it. They are between you and Use Pure Water, 1040 Grant Rd Suite 187, Mountain View, CA 94040 ("Use Pure Water," "we," "us," or "our"), the local delivery service for Pure Water of Mountain View.

1. Acceptance of these terms

By visiting or using this website, submitting a request form, opening a checkout link, or placing an order, you agree to these Terms. If you do not agree, please do not use the website. If you use the website on behalf of a business, you confirm you are authorized to accept these Terms for that business.

At checkout we also ask you to accept these Terms and the Delivery Service Agreement with a checkbox. Electronic acceptance has the same effect as a written signature, and we record which version you accepted. This page is publicly available and can be printed or saved at any time.

2. What this website does

The website describes our water products and service area, lets you request purified or alkaline water delivery for a home or business, and lets you set up recurring delivery through checkout. Submitting a request form does not by itself start service or charge a payment method. We confirm your service area, schedule, products, and price before recurring delivery begins.

Prices, products, and delivery options shown on the website may change and are subject to availability in your area. A price on a marketing page is an estimate unless it appears in your checkout summary or order confirmation. Applicable taxes and government-imposed fees are added where they apply.

3. Accounts and checkout links

Some parts of the service use a personal checkout link or account link that we send you by email or text message. Those links are specific to you and let whoever holds them see and change your order details. Keep your link private, do not forward it, and tell us right away if you think someone else has it so we can replace it.

You agree to give accurate, current information when you request service or check out, including your name, contact details, service address, and payment information, and to keep that information up to date. You are responsible for activity that takes place through your account or your checkout link.

4. Delivery service, the Delivery Service Agreement, and privacy

Recurring water delivery itself is governed by our Delivery Service Agreement, which covers month-to-month service, billing and card authorization, price-change notice, equipment rental, and cancellation. If anything in these Terms conflicts with the Delivery Service Agreement for your delivery account, the Delivery Service Agreement controls for that account.

Our Privacy Policy explains what personal information we collect through the website, checkout, and delivery operations, how we use and disclose it, how long we keep it, and the privacy choices and requests available to you.

5. Service communications

By submitting a request or placing an order, you authorize us to contact you by phone and email about your request, delivery account, order, pricing, schedule, billing, and service issues. These are service communications about something you asked us for, and they are part of providing the service rather than marketing.

Text message notifications are separate and are covered by the text message program below. They require your own SMS opt-in. Any marketing email we send includes an unsubscribe link; unsubscribing from marketing does not stop service communications about an active delivery account.

6. Text message program

If you provide your mobile phone number and actively opt in to Use Pure Water text messages, you consent to receive recurring automated and non-automated text messages from Use Pure Water about your water delivery service. Messages may include delivery reminders, driver assignment notices, out-for-delivery updates, delivery confirmations, delivery details, account or schedule updates, change-request follow-up, and customer support responses.

Message frequency varies based on your delivery schedule and account activity, and recurring delivery customers may receive up to 6 messages per delivery cycle plus responses to customer-initiated requests. Message and data rates may apply. Consent to receive text messages is not required to make a purchase.

You can opt out of text messages at any time by replying STOP. For help, reply HELP or contact Use Pure Water at support@usepurewater.com or (650) 938-3122. After you opt out, we may send one confirmation message and then will not send further text messages unless you opt in again. Carriers are not liable for delayed or undelivered messages. We do not disclose mobile numbers or SMS consent to third parties for their own marketing, as described in the Privacy Policy.

We may limit or end website access, and suspend or cancel an order, if we reasonably believe these Terms have been broken.

8. Intellectual property

The website and its content, including text, page design, graphics, photographs, logos, and the Use Pure Water name and marks, are owned by Use Pure Water or its licensors and are protected by intellectual property law. We grant you a limited, personal, revocable permission to view and use the website to learn about, request, and manage water delivery. All other rights are reserved. Third-party names and marks that appear on the website belong to their respective owners.

9. Third-party services

The website relies on third-party providers for hosting, databases, payment processing, email and text messaging, address lookup and routing, and optional analytics and advertising measurement. Those providers process information as described in the Privacy Policy. Links to third-party websites are provided for convenience; we do not control those sites and are not responsible for their content or practices.

10. Disclaimers and limitation of liability

Information about purified water, alkaline water, pH, taste, or hydration on this website is general product information. It is not medical advice and is not a claim to diagnose, treat, cure, or prevent any disease or condition.

The website is provided on an as-is and as-available basis. To the fullest extent permitted by law, and apart from warranties that cannot be disclaimed, we disclaim implied warranties relating to the website, and we do not promise that it will be uninterrupted, error-free, or free of inaccuracies. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website. Nothing here limits rights you cannot waive under California law, and nothing here changes the liability terms that apply to delivery under the Delivery Service Agreement.

11. Governing law and disputes

If you have a concern, please contact us first at support@usepurewater.com or (650) 938-3122 so we can try to resolve it directly. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Court proceedings will take place in Santa Clara County, California, unless applicable law requires otherwise. Either of us may bring a qualifying claim in small claims court.

12. Changes to these terms

We may update these Terms by posting a revised version on this page with a new effective date and version identifier. Changes apply to website use after they are posted. For a change that materially affects an active delivery account, we will give notice by email in the way described in the Delivery Service Agreement. Continuing to use the website after an update means you accept the updated Terms.
