1. Parties
This Delivery Service Agreement is between Use Pure Water ("Company") and the customer named in the Order Summary ("Customer"). The agreement becomes effective when signed or electronically accepted.
2. Service
Company will deliver bottled purified water, alkaline water, related bottles, and optional dispenser equipment to the service address listed above. Delivery is subject to route availability, safe access, weather, traffic, inventory, and Customer compliance with this agreement.
3. Initial Term and Renewal
Unless the Order Summary states otherwise, recurring service begins with a 12-month initial service term. After the initial term, service continues on a month-to-month basis until canceled by either party as allowed by this agreement. The renewal terms, price, frequency, and cancellation method must be disclosed before Customer gives affirmative consent.
4. First Delivery Offer
If Customer receives a free first delivery promotion, the delivery service charge for the first delivery is waived only to the extent stated in the Order Summary. Product charges, deposits, taxes, optional equipment, replacement fees, and other clearly disclosed charges may still apply.
5. Pricing, Fees, and Payment
Customer agrees to pay the charges shown in the Order Summary and any later written changes accepted by Customer. Company should disclose all mandatory charges before payment authorization. If recurring automatic payment is used, Customer authorizes Company or its payment processor to charge the selected payment method according to the disclosed billing schedule.
6. Bottles, Deposits, and Equipment
Bottles, racks, dispensers, and other equipment supplied by Company remain Company property unless sold in writing. Customer is responsible for loss, damage, contamination, or failure to return Company property. Refundable deposits may be applied to unpaid charges, missing bottles, damaged bottles, dispenser damage, or other amounts owed.
7. Delivery Access and Missed Deliveries
Customer must provide safe, reasonable access for delivery and pickup. Company may skip, reschedule, or charge a disclosed missed-delivery or special-trip fee if access is blocked, bottles are not available for exchange, animals or hazards are present, or Customer requests delivery outside the normal route.
8. Bottle Handling
Customer should store bottles in a cool, clean place away from chemicals, heat, pests, and direct sunlight. Customer should not refill, alter, misuse, or contaminate Company bottles.
9. Changes to Service
Customer may request changes to water type, quantity, frequency, delivery day, address, or equipment. Changes are not effective until confirmed by Company. Price or fee changes require advance notice as required by law.
10. Cancellation and Termination
Customer may cancel recurring service by email, phone, or any online cancellation method Company provides. Company should make cancellation available in the same medium used to activate online service where required by law. Cancellation does not waive amounts already owed, replacement charges, unreturned equipment, or bottle deposits applied to unpaid balances. Company may terminate service for nonpayment, unsafe delivery conditions, unavailable routes, misuse of equipment, or breach of this agreement.
11. Acknowledgment After Signup
Customer should receive a copy of the accepted automatic-renewal or continuous-service terms, cancellation policy, and cancellation instructions in a retainable form after signing.
12. Communications
Customer authorizes Company to contact Customer about delivery, account, billing, route, agreement, and service issues. Marketing text messages require appropriate consent and opt-out instructions.
13. Water Quality and Product Information
Company will use commercially reasonable practices for product handling and quality control. Product statements about taste, purification, alkalinity, pH, or minerals are not medical claims.
14. Limitation of Liability
To the fullest extent permitted by law, Company is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Company's total liability for a delivery issue should not exceed the amount paid by Customer for the affected delivery, except where prohibited by law.
15. Governing Law and Disputes
This agreement is governed by California law. Venue for court proceedings should be in the county where Company is located or where the service address is located, unless applicable law requires otherwise.
16. Electronic Signature
Customer agrees that an electronic signature, checkbox, typed name, or electronic acceptance may create a valid and enforceable agreement where permitted by law. Customer should be able to retain a copy of the signed agreement.
